With 14+ federal trial courts, it's spreading, not like a wildfire, but slow and sure. What is it? Judges requiring identification of the use of genAI and that all such AI-generated text has been reviewed by a human. Bob Ambrogi notes that now the 5th U.S. Circuit Court of Appeals is considering adoption of this kind of rule. Bob writes, "A material misrepresentation with regard to the use of AI could lead to rejection of the document and sanctions imposed on the person who filed the document." So here is my question, once the lawyers and filers note that they have used genAI text (and properly reviewed it), what is in the judges mind? Can he or she become biased against the arguments knowing they may have originated in an artificial mind?
