On Friday, September 9, the Westchester/Southern Connecticut Chapter of the Association of Corporate Counsel will present Negotiation Ethics for In-House Counsel - Walking the Line Between "Puffing" and Lying.
The program is being held at the Indian Harbor Yacht Club, 710 Steamboat Road in Greenwich, Connecticut. It begins at 8:30 a.m. and ends at noon.
One of the starkest examples of the tension between an attorney's duty to achieve the client's goals and his or her duty of honesty may occur in negotiations with an adverse party. This seminar will address the limits to what an advocate can or cannot say during the course of a negotiation. The speakers, David Atkins and Alex Hernandez, partners at Pullman & Comley LLC, will discuss the duty of counsel to correct misunderstandings, or to refrain from correcting misunderstandings or mistakes of adversaries. Topics will examine whether, like a firm lawyer, an in-house counsel is ever required to actually refuse a client's negotiating instructions even if the client is also the counsel's employer.
Other topics will focus on risks in negotiation; when half-truths and exaggeration become misleading; and in-house issues around honesty.
