WESFACCA Seminar To OutlineEffect Of New EPA Rules

The Westchester-Southern Connecticut Chapter of the Association of Corporate Counsel America (WESFACCA) this month is offering a CLE seminar titled Update: EPA Final Rule: 'All Appropriate Inquiries' - How to Claim Protection From Superfund Liability.

The program will take place on Friday, December 8 from 9 to 11:30 a.m. at Malcolm Pirnie, White Plains, NY.

Last month, the EPA's Final Rule of 'All Appropriate Inquiries' became effective. The program will outline what that means to purchasers of real estate who must now comply with the standards set by the Final Rule or the ATSM Phase I Environmental Site Assessment Process, to satisfy the requirements for conducting all appropriate inquiries. If either of these standards is complied with, a purchaser may potentially claim protection from liability under CERCLA (Superfund) as an innocent landowner, bona fide prospective purchaser or contiguous landowner.

Speakers will be Sven-Erik Kaiser, U.S. EPA Office of Brownfields Cleanup and Redevelopment, and Chet Thompson, former deputy general counsel, EPA.
