University Of Texas To Explore International Arbitration At The Hague

The University of Texas School of Law, along with the Permanent Court of Arbitration and the Houston International Arbitration Club, has scheduled a two-day conference titled Weighing the Facts: Information Exchange and Presentation of Evidence in International Commercial and Investment Arbitration.

Scheduled for Thursday and Friday, May 14 and 15, the conference will be held at Academy Hall, the Peace Palace at The Hague, the Netherlands. Registration begins on day one at 8 a.m. followed by remarks by Christiaan Kroner, secretary-general, Permanent Court of Arbitration, The Hague. The program follows, from 9 a.m. until 4:45 p.m., when participants will adjourn to a reception and private tour of the Peace Palace. On Friday, the program begins at 8:30 a.m. and adjourns at 12:30 p.m.

On Thursday, a panel discussion titled Evolving Principles of Information Exchange: Consensus and Divergence will be moderated by William H. Knull III, Mayer Brown LLP. Panelists include Mark Appel of the American Arbitration Association, Dublin, Ireland; John Beechey of the International Chamber of Commerce, Paris, France; and Otto Lo de Witt Wijnen, Ideaka BV, the Netherlands. Other topics for discussion are the present and future of electronic disclosure in international arbitration; evidence issues in arbitration with States, including allegations of witness intimidation, illegally obtained evidence, and the invocation of political sensitivity; and privilege and ethical obligations involving production and protection of evidence. Friday's program includes a general counsel panel from a variety of global companies to discuss the practicalities of preserving and producing evidence in arbitration proceedings with Paul Wright of Exxon Mobil Corp., Houston, as moderator.
