The Boston Bar Association (BBA) this month will present a CLE seminar titled Handling Retaliation Cases - The Cutting Edge.
The program will, take place on Wednesday, March 28 from 4 to 7 p.m. at the BBA Conference Center, 16 Beacon Street, Boston.
The session will help attorneys understand the current state of the law, how various state and federal laws differ, differences in claims under various statutory schemes, how to establish the claim, and what defenses are effective.
Specific discussion topics will include: what an "adverse action" is in state and federal retaliation claims under M.G. L. c. 151B and Title VII after Burlington Northern v. White; establishing that plaintiff has engaged in protected conduct; retaliation protections under other statutes, particularly the Sarbanes-Oxley Act, NLRA and the False Claims Act, and measures employers should take to prevent retaliation claims.
