San Diego ACC Explains What General Counsel Should Know About The "Cumis" Doctrine

As part of the Meet Your Counterpart series, the ACC San Diego chapter will present Ten Things Every General Counsel Should Know About the "Cumis" Doctrine.

It will be held on Tuesday, July 12, at the Doubletree Del Mar, 11915 El Camino Real in San Diego, beginning at 4:30 and ending at 7:00 p.m.

As a rule, an insurance company who owes its policyholder a "duty to defend" has the right to select the defense counsel - except in cases when the policyholder is entitled to independent counsel or Cumis counsel, which is counsel of the policyholder's choosing but paid for by the insurance company. Cumis counsel can be extremely valuable to a policyholder, which is why insurance companies are loath to agree to them.

During this program, insurance coverage experts from Osborne & Nesbitt LLP will explain 10 things every general counsel should know about the valuable rights afforded to corporate policyholders by the Cumis doctrine. The program will answer many questions about Cumis, including the conflicts that trigger a policyholder's right to be represented by Cumis counsel; the advantages to a policyholder of being represented by Cumis counsel verses insurer-appointed panel defense counsel and any possible disadvantages; and the fees and costs of Cumis counsel an insurance company is expected to pay.
