Pennsylvania Bar Institute Seminar To Review Burlington Northern Case

The Pennsylvania Bar Institute (PBI) this month is offering a CLE seminar titled Retaliation: The Hottest Issues in Employment Discrimination Law.

The program will take place on Tuesday, December 12 from 9 am to 12:15 p.m. at Penn State Great Valley, 30 East Swedesford Road, Malvern PA.

The focus of the program will be the Supreme Court's decision in Burlington Northern and Santa Fe Railroad Company v. White. Discussions will cover: what constitutes 'retaliation' in the aftermath of Burlington Northern; what types of actions by an employer are likely to be considered 'materially adverse' to a reasonable employee; whether actions by an employer occurring outside the workplace can be considered 'retaliatory'; how an employer may legally make changes to an employee's job duties after the employee has made a claim of discrimination, and what impact Burlington Northern has on an employer's treatment of former employees.
