The New York County Lawyers' Association (NYCLA) on Wednesday, March 16 has scheduled a CLE seminar titled Ethical Considerations in International Transactions.
There is not much guidance for American lawyers practicing internationally primarily because many legal organizations and the public are concerned with disciplining domestic lawyers and United States standards traditionally are applied to litigation and not transactional work, which constitutes the majority of international law practice.
A panel of experts will address the various ethical issues faced by the attorney engaged in international transactional matters.
Areas to be discussed include:
- What practicing law internationally means within the bounds of the ABA Model Rules of Professional Conduct, governing New York Judiciary and case law;
- What disciplinary rules apply to attorneys engaged in international transactional work;
- The ethical considerations raised when handling matters yourself versus engaging foreign counsel, including issues of illegality and competency;
- What to look for when seeking or recommending foreign counsel, including issues of due diligence and duties of continuing supervision.
Speakers will be Gisella Levi Carotti and Mark A. Meyer, Herzfeld & Rubin, P.C., and George F.A. Parnell, Holland & Knight LLP.
The program will take place from 6 to 9 p.m. at the NYCLA Home of Law, 14 Vesey Street, New York City.
