New York State Bar Explores Depositions In The Digital Age

On Thursday, October 27, the New York State Bar presents The Art of Deposition in the Digital Age. It will be held at the Affinia Manhattan at 371 Seventh Avenue in New York City. The program schedule will be available online shortly.

Digital technology has vastly changed the deposition process for both sides of the deposition table. Over reliance on technology can distract practitioners from concentrating on the art of the deposition and achieving the primary objectives of an effective examination. Under reliance on available technologies and changing rules of evidence and discovery can also put counsel at a competitive disadvantage relative to more techno-savvy opposing counsel.

Utilizing technology, including the assistance of co-counsel from remote locations, video testimony and instant transcription, among others, can vastly improve the deposition experience if applied correctly to the age-old art form of eliciting necessary testimony. This seminar will approach the issue of technology in the deposition from both the practitioner's and the witness's perspectives.

Panelists will provide an overview of technology changes, case law, rules of discovery, use of technology in witness preparation, the witness's perspective and other aspects of examinations under oath. A demonstration with a mock deposition will highlight some of the key points made by the presenters.
