Law360 podcast explores the perils, pitfalls and promise of cannabis

Legal news organization Law360, a LexisNexis company, announces the launch of a new podcast series, Law360 Explores: Legalization. Hosted by senior cannabis reporter Diana Novak Jones, the podcast looks at the murky legal scenarios cannabis businesses must face, as told by the business owners and attorneys on the front lines.

While the marijuana industry has been operating in the shadows for decades, it’s now legal in more than 40 states. As one of the newest and most dynamic industries, retail sales are projected to reach $45 billion over the next five years.

But cannabis remains federally prohibited, putting businesses under unique legal pressure.

“Industry growth shows no signs of stopping as more and more states choose to legalize. But marijuana remains federally illegal, which has created deep tensions for the industry,” says Amber McKinney, Law360 Managing Editor. “State-legal cannabis companies are facing so many challenges other businesses don’t have to handle. Taxation can put you out of business. Banking is a struggle. Intellectual property protection at the federal level is dicey. State regulations are constantly changing, and the legal ethics for attorneys helping federally illegal companies are hazy at best.”
