The Washington, DC Bar Association is presenting a two-part seminar titled A Practical Guide to Attorney-Client Privilege and Work Product Doctrine. On both Wednesday, March 11 and Wednesday, March 18, the program will be held from 6 p.m. until 8:15 p.m. at the DC Bar Conference Center, 1250 H Street, NW in Washington, DC.
This program will explore perhaps the most important legal doctrine with which any lawyer must be familiar: the attorney-client privilege. Lawyers face privilege issues nearly every time they communicate, and this program will focus on the types of communications in which lawyers are most likely to engage.
Topics to be covered include participants in privileged communications, the content of the communication, the context of the communication and waiver, including the sharing of privileged communications outside the company, inside the company beyond those with a "need to know" and the dangerous possibilities of an implied waiver. The session will also cover the very different but related work product doctrine, including the "temporal" and "motivational" elements of the doctrine, how work product protection might be overcome by a client's adversary, and waiver.
Thomas Spahn, McGuireWoods LLP, will lead the program.
