Commercial arbitration will be examined this month by the Association of the Bar of the City of New York (ABCNY) in a video replay of a CLE seminar titled Practicing Commercial Arbitration Today - 1st Class Justice.
The program will take place on Tuesday, August 17 from 9 a.m. to 5 p.m. at the House of the Association, 42 West 44th Street, New York City.
Several panels of experienced advocates and arbitrators will tackle the significant and complex issues facing advocates and arbitrators today. They will discuss:
How arbitrators manage the process efficiently, without making arbitration too similar to litigation, but leaving even the losing parties satisfied with the result;
How consumer arbitration issues affect the goals of the commercial process;
The role of the court in deciding arbitrability, intervening in an ongoing arbitration or reviewing arbitration awards during and after the arbitration proceeding;
How the advocate protects against an arbitration malpractice action when the case is lost;
When intervention by a mediator is most effective.
Panelists will describe process frameworks and procedures that streamline arbitration proceedings and suggest workable solutions to these emerging issues.
The co-chairs for the day-long session are Deborah Masucci, director of dispute resolution, AIG, and Nancy Nelson, CPR Institute for Dispute Resolution. Among the speakers are Diana Lurie Boersma, assistant general counsel and corporate secretary, Hitachi America Ltd.; June R. Lehrman, the Hon. Kathleen A. Roberts and the Hon. Curtis E. von Kann, all of JAMS, and Thomas Stipanowich, CPR Institute.
