The treatment of computer-based information in discovery creates major challenges and risks for companies. These challenges will be examined this month by the Greater New York Chapter of the Association of Corporate Counsel-America at a CLE seminar titled Electronic Evidence Discovery: What You Don't Know Can Hurt You; What You Don't Know You Don't Know Can Hurt You Even More.
The program co-sponsored by the Kelly Law Registry and the firm of Mayer, Brown, Rowe & Maw, LLP, is scheduled for Wednesday, October 20.
This session will discuss the emerging judicial trends on key electronic discovery and records management issues, including cost-shifting for electronic discovery requests, the review of backup tapes, and preservation of electronic materials upon notice of litigation.
The program will cover best practices for companies and their counsel to consider when handling electronic information both from the records management and litigation perspectives, and the proposed amendments to the Federal Rules of Civil Procedure to address the special problems that electronic discovery has created in the courts.
Speakers at the day-long session will be Ashish S. Prasad, Mayer Brown, and John H. Jessen, founder and CEO of Electronic Evidence Discovery, Inc.
