The Greater New York Chapter of the Association of Corporate Counsel will present Increased EEOC Systemic (Class) Investigations and Litigation. It will be held on Monday, February 13, at the offices of Orrick, Herrington and Sutcliffe LLP, 51 West 52nd Street in New York City and will begin at 4:30 p.m. and end at 7:00 p.m.

With private class action plaintiffs suffering a major setback in Dukes v WalMart, the EEOC continues to ramp up its systemic investigation and litigation program. Numerous investigations and litigations have been brought by the EEOC during this administration challenging disparities in pay and promotion and the use of pre-employment tests and criminal and credit background checks. EEOC requests for the production of company-wide human resource data have become standard operating procedure and the need for appropriate statistical analysis of that data has become critical. Mike Delikat and Jill Rosenberg from Orrick, Herrington & Sutcliffe LLP will report from the front lines on the EEOC's systemic initiative and Charlie Diamond and Michael Kwak from FTI's labor economics team will discuss best practices in the statistical analysis of company human resource data and proactive auditing.
